DMCA Policy for Military Mutual

The Digital Millennium Copyright Act (“DMCA”) provides a process for copyright holders, including software developers and content creators, to request the removal of infringing material from online platforms. For more information about the DMCA, please visit the official website of the U.S. Copyright Office.

As with any legal matter, we recommend consulting a professional before taking any action that could impact your rights. This guide is for informational purposes only and does not constitute legal advice.

Accurate Information

The DMCA requires that anyone filing a notice of copyright infringement does so under penalty of perjury. Submitting false information in a sworn declaration is a federal offense under U.S. Code, Title 18, Section 1621. Additionally, false claims can lead to civil liability, including monetary damages.

Investigate Before Filing

At Military Mutual, we respect the rights of creators, and we take copyright infringement claims seriously. Filing a DMCA notice of infringement is a legal action that carries real consequences. Before submitting a takedown request, we strongly encourage you to:

  • Conduct a thorough investigation.
  • Confirm that the alleged infringement is not covered by fair use or other legal protections.
  • Attempt to contact the individual responsible for the content in question to resolve the issue directly.
  • Consult with an attorney if you are uncertain about the validity of your claim.

No Automated Submissions

All DMCA notices must be reviewed by a trained professional before submission. If you are using a third party to manage your copyright claims, ensure that they do not rely on automated bots to submit takedown requests in bulk. Automated claims are often invalid and may result in unnecessary content removal.

DMCA Counter Notices

If a DMCA takedown notice affects a user’s content, they have the right to submit a counter notice. In such cases, Military Mutual will restore the removed content within 14 days unless the copyright claimant notifies us that they have initiated legal proceedings against the user regarding the alleged infringement.

DMCA Notice Review Process

Military Mutual does not evaluate the validity of copyright claims beyond ensuring that they meet the minimum legal requirements under the DMCA. It is the responsibility of the involved parties and their legal representatives to assess the merits of a claim. All notices must be submitted under penalty of perjury.

  3. Identification of the allegedly infringing material and information sufficient for us to locate it on our website or platform.
  4. Your contact information, including address, phone number, and email.
  5. A statement that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
  6. A statement affirming that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Submitting a DMCA Counter Notice

If you believe that your content was mistakenly removed due to a DMCA takedown notice, you have the right to file a counter notice. Before submitting, ensure that your content does not infringe on another party’s copyright and that you meet the legal requirements for a counter notification.

To submit a DMCA counter notice, send an email to [email protected] including:

  1. Your name, address, and contact information.
  2. A description of the removed content and its location before removal.
  3. A statement under penalty of perjury that you believe the removal was due to a mistake or misidentification.
  4. A statement consenting to the jurisdiction of the federal courts in your district and agreeing to accept service of process from the original complainant or their agent.
  5. Your physical or electronic signature.

Upon receiving a counter notice, we will forward it to the original complainant. If they do not notify us within 14 days that they have initiated a legal action against you, we will restore the removed content.
